Who provides the service
Habitio is a service provided by Yasser Santiago, tax ID Y4869602X. Contact: hola@habitio.co. By using Habitio you accept these terms.
What Habitio is and what it isn’t
Habitio is a tool for organising your rentals: properties, rent, costs, contracts, tenants and documents.
It is not tax, legal or investment advice. The income-tax and corporate-tax reports, the tax pot and the investment evaluator are estimates, calculated with the rates and assumptions you configure. They are there to orient you, not to file a tax return or to decide on a purchase by themselves. Before filing, talk to your accountant; before buying, to whoever is appropriate. We are not liable for decisions taken on these figures alone.
The evaluator’s local price and rent estimates are generated by a language model. They are unverified approximations and are labelled as such on screen.
Your account
You are responsible for keeping your password safe and for what is done from your account. If you invite someone into your organisation, you are giving them access to that organisation’s data according to the role you assign. Tell us if you think someone has got in without permission.
Your tenants’ data is your responsibility
When you enter your tenants’ data, you are the controller and we are the processor. That means it falls to you to have a legal basis for processing it and to inform them that you use a tool like Habitio. We store it, process it following your instructions and use it for nothing else. The details are in the privacy policy.
Prices and payment
Published prices are monthly and exclude VAT. There is no minimum term: you can cancel whenever you like and the service stays active until the end of the period you’ve paid for. If we change prices, we give you at least 30 days’ notice and the change does not affect the current period.
Your data comes with you
You can ask us for an export of your data at any time and we’ll give it to you in a reusable format. If you cancel, we keep your data for 30 days so you can retrieve it, and delete it after that.
Availability
We do what is in our hands to keep Habitio available, but we don’t guarantee uninterrupted operation: we depend on third-party providers and there is maintenance from time to time. When an interruption is foreseeable and prolonged, we give notice.
Keep copies of whatever is critical to you. Although we maintain backups, they are no substitute for you holding on to the important documents yourself.
Acceptable use
Habitio may not be used for anything unlawful, nor to enter people’s data without a basis for doing so, nor to attempt to reach other organisations’ information, nor to resell the service as your own. We may suspend an account that does any of those things.
Liability
Except where the law does not allow it to be limited, our liability is capped at the amount you have paid for the service in the previous twelve months. We are not liable for lost profits or indirect damages.
Changes and governing law
If we amend these terms, we will tell you with reasonable notice. Spanish law applies, and the courts determined by consumer legislation where you act as a consumer.
Which version prevails
This is a translation, provided so it can be read in English. Habitio operates under Spanish law and the Spanish version of these terms is the one that governs: if the two ever differ, the Spanish version prevails.
